The Queensland Integrity Commissioner (QIC) and the Independent Assessor have developed a framework to assist Councils to make good decisions.

The Meeting Aid for Councillors – Conflict of Interest (PDF, 187KB) is a step-by-step guide to assist councillors and councils to identify, determine and manage a potential conflict of interest involving councilors in matters before Council.

2. Personal Interests and Official Responsibilities: A Guide for Local Government

Personal Interests and Official Responsibilities: A Guide for Local Government (PDF, 193KB) will assist councilors to identify and manage conflicts of interest and material personal interests at Council meetings. It is also designed to promote best practice standards and ensure that public interest is at the forefront of council decision-making. This framework is supported by research outlined in the QIC's research paper: Personal Interests and Official Responsibilities: Developing an Interests Management Framework to Guide Practice at Local Government Level.

3. Aid for Councillors: Material Personal Interest

The Local Government Act 2009 provides that if a councillor has a material personal interest at a meeting, the councillor must inform the meeting of that interest and leave the room. The councillor must stay out of the meeting while the matter is being discussed and voted on. It is up to individual councillors to decide if they have a material personal interest.

4. Councillor Aid – Duty to Report

Under section 175G of the Local Government Act 2009 councillors have an obligation to raise concerns about other councillor’s conflicts of interest or material personal interests at Council meetings.

This Aid contains questions to ask yourself in considering any potential conflict and whether to raise it.
