If a councillor receives a conduct complaint from a member of the public or another councillor they must refer it to the Independent Assessor. Corrupt conduct must be reported to the Crime and Corruption Commission.

If a councillor becomes aware of another councillor engaging in inappropriate conduct or misconduct they must refer it to the Independent Assessor.

Local governments, usually the chief executive officer or mayor, must give notice to the Independent Assessor if a councillor has been disciplined for inappropriate conduct on three occasions in a 12 month period.

The local government must notify the Independent Assessor if it has made an order about a particular type of conduct engaged in by a councillor. It will be dealt with as misconduct if the local government reasonably suspects that a councillor has engaged in the same type of conduct.

Management of Conflicts of Interest

The Office of the Queensland Integrity Commission (QIC) and the Office of the Independent Assessor have developed a meeting aid and conflict of interest framework to assist councillors to make good decisions.

There is also an aid for councillors to determine Material Personal Interests and an aid to assist councilors to determine when they have a Duty to Report another councillor’s interest.

Transitional arrangements for the processing of complaints

Existing complaints that are not assessed by 3 December 2018 will be assessed under the new system.

Complaints assessed as inappropriate conduct, where a final decision on how it should be dealt with is not finalised by 3 December 2018, will be dealt with under the former legislative provisions.

Complaints assessed as misconduct, where a final decision on how it should be dealt is not finalised by 3 December 2018, will be dealt with under the new system.

Disciplinary orders for misconduct and inappropriate conduct made before 3 December 2018 that are still existing, can be taken into account by the local government or the Independent Assessor when deciding on conduct matters.

Recommendations made by the Local Government Remuneration and Discipline Tribunal to dismiss or suspend a councillor, made before 3 December 2018, where the Minister has not made a decision, will still stand and be dealt with under the new system.
