A misconduct finding against Cr James Hansen of the Fraser Coast Regional Council is the first to be fast-tracked by the Office of the Independent Assessor to the Councillor Conduct Tribunal.

The tribunal found Cr Hansen breached the Councillor Code of Conduct after admitting he made a social media comment that referred to the cultural background of one of the complainants.

The Tribunal was satisfied that as well as the breach, there was a failure to comply with the principles of the Local Government Act, and this constituted a breach of trust.

Cr Hansen’s early admission of the facts saved the OIA the cost of a full investigation and the Tribunal took this into account when deciding the penalty.

Cr Hansen also apologised in person to the complainant.

The Tribunal ordered Cr Hansen make a public admission that he engaged in misconduct at an ordinary meeting of the Fraser Coast Regional Council, within one month.

Consistent with reporting in the Fraser Coast Chronicle on 20 March 2019, the OIA acknowledges that it has been notified of a further social media matter regarding Cr Hansen, that occurred after this Tribunal decision was handed down.
